General Terms and Conditions of business and the use of the website www.fragrance-perfumes.eu are drawn up in accordance with the Consumer Protection Act and other statutory legislation for online sales and such business practices. The Terms cover the operation of Fragrance perfumes and the business relationship between Sostasa d.o.o. (hereinafter: Sostasa), registered users (hereinafter: users) and buyers of goods or services (hereinafter: customers).

1. General Information About Fragrance Perfumes

Fragrance perfumes is a website that sells fragrances inspired by original perfumes, and which originate from Italy, from the city of Milan.

2. Offer and Origins

Due to the nature of the business, the offer on the website may vary daily. The prices of individual goods are regular and special prices or discounted prices.
Sosatasa d.o.o. is responsible for the quality of the goods or the performance of the service. Sostasa is also responsible for any complaints or consequences that may arise when a user uses the goods or service. Sostasa d.o.o. is fully responsible for the performance of the services or the sale of the goods and any potential related complaints.

The photographs, images or recordings published as part of the offers are the property of Sostasa d.o.o. or its suppliers, business partners or are merely symbolic and do not guarantee the precise characteristics of the product or service, and may represent a symbolic or actual service, offer, company or goods.

3. Purchase and Invoice

Sostasa d.o.o. acts as a company that offers goods or services over the Internet.
The buyer pays the amount due to Sostasa d.o.o. and receives an invoice along with the goods or services. The company operates in the territory of the Republic of Slovenia.
We ship products in the area of the EU.

By registering, the visitor / customer becomes a user and gains the right to purchase and access to all the contract information remotely.

The contract of sale between Sostasa d.o.o. and the customer of the online store www.fragrance-perfumes.eu is concluded at the moment when Sostasa d.o.o. sends the first electronic message to the customer on the status of their order (address: Fragrance-perfumes.eu – confirmation of order no. _ ).
From this moment on, all prices and other conditions are set and apply to Sostasa d.o.o. and the customer. A customer is a person with the data as indicated at the time of the submission of the purchase order. Later changes of the customer’s data are not possible.

The purchase contract (the first electronic message on the submission and the status of the order) is stored electronically on the server of the company Sostasa d.o.o.

Each package also contains a physical invoice, which the customer may also receive via email.

In order to supply goods or services, the seller must issue an invoice and deliver it to the customer. The customer must take over the invoice and keep it immediately after leaving the premises.

4. Methods of Payment

5. Offer Price

Prices for all offers of goods or services are pre-determined and include VAT.
Prices are valid for all customers, but only for the duration of each offer and in the case of payments specified in these terms, and only at Fragrance-perfumes.eu.

Prices are valid until the time of delivery of the product. We reserve the right to change the prices.
Prices are rounded to two decimals.

6. Registration and Purchase Procedure at Fragrance-perfumes.eu

The user can place the order as a guest or as a registered user.

In order for a user to see their order history on the Fragrance perfumes website, add products to their favourites and keep track of currently unavailable products, they must register. The user provides their information, email address, shipping address and other data. The username is assigned by Fragrance perfumes and represents the user’s email address. The user receives their first password from Fragrance perfumes, and later the user can change the password at any time. The password is received by email. Registration allows the user to make a purchase.

– A user is assigned a user name that is the same as their email address and a password (they can change their password later). They receive a password to their email address to access their profile.
– The user decides on the offer, chooses a payment method and makes a purchase.

After placing the order, the buyer receives an email notification that the order has been accepted into queue. The buyer has, until the dispatch of the goods (status in preparation), the right to withdraw from the remote contract (the order must be cancelled by email at info@www.fragrance-perfumes.eu). It is mandatory to enter the order number. The e-mail address from which you cancel your order must match the e-mail address used to confirm the purchase. If the customer does not cancel the order, the order will be processed further. The seller may call the customer at their contact telephone number to verify the information or to ensure the accuracy of delivery. Upon confirmation of the order, the provider shall notify the buyer by e-mail of the estimated delivery time. The contract for the purchase of ordered items between the buyer and the seller is irrevocably concluded at this stage. Until the customer, at the seller’s request, has settled the amount or prepayment on the pro forma invoice as collateral for the seriousness of the transaction, it is considered that the customer has not accepted the offer and that the contract has not been concluded. Sostasa d.o.o. shall inform the buyer immediately in such cases.

Secure authorizations and payment card transactions are performed in real time by checking the information with the banks immediately. Card information is not stored on the server.

8. Personal Data Protection

Sostasa d.o.o. is committed to protecting users’ data carefully and in accordance with the law.

Complaints regarding the quality or performance of the offer are settled between the buyer and Sostasa d.o.o.

12. Disclaimer

The web site fragrance-perfumes.eu operates by means of catalogue sales of goods and services. Despite efforts to maximize the accuracy and timeliness of the offer, information about the goods and services and the price may change so quickly that it cannot be corrected and is still unchanged on the website. In the case of an order for such goods or services, the company notifies the buyer of the changes and cancels the purchase, or allows them to cancel the order or arrange for another option respectively.
We reserve the right to make typographical errors and errors that would result from the unintended malfunctioning of the website’s IT system.
The company is not responsible for the accuracy of the information entered by the customer.

13. Delivery

Delivery takes up to 7 business days – there are no deliveries on weekends and holidays.

– The supplier will deliver the goods or services within the agreed time.
– DPD is the contractual partner for the delivery of the items.
– Shipping cost is set at € 3.80, including VAT. – For purchases over 50 €, the shipping is FREE.
– Our partner delivers packages in the morning to the address entered when placing the order.
– As the delivery service delivers the items in the morning, you can also opt for delivery to any other name or address.
– If you are not at the place of delivery (business, office, etc.) at the time of delivery, the courier will leave a message indicating instructions for later pickup.
– If the buyer does not receive the goods within a few days of dispatch, they must immediately inform the supplier.
– In this case, the provider shall identify the causes and inform the buyer thereof.

How long does it take for me to get the product I ordered?

The order will be delivered in 7 business days (if the order is placed on the same day by 1 pm * on Mondays until 11 am). There are no deliveries during weekends and holidays.

How much does shipping cost? 

The shipping cost is fixed (€ 3.80) and does not depend on the quantity of products ordered. – For purchases over 50 €, the shipping is FREE. The DPD courier can be paid by cash or credit / debit card upon delivery. In case of unsuccessful delivery attempt, the DPD courier will leave you a message about the arrival of the shipment. The message indicates the package number, telephone number of the delivery service DPD (_________) and their email address (info@dpd.si).

How can I pick up products through DPD Delivery?

Payments on delivery (You can pay the package price to the DPD courier on delivery by cash or credit / debit card):
Delivery of the ordered products in our online store is made as soon as possible and depends on the availability of the products. We will deliver the products via the DPD delivery service to the address which you provided at registration or purchase process, we recommend that you provide the address where you are in the morning. We also recommend that you write a mobile number at which you can be reached in the morning, as the courier will be able to call you and agree with you on the method of delivery. The phone number is used solely for better delivery quality.

The package can be delivered to the address you wrote down at the time of ordering, it can be delivered to another address, if it is more convenient for you at the moment, but it can also be delivered to a post office of Pošta Slovenije or Petrol service station, where you can pick it up with a personal document and a number of the package.

We deliver the ordered goods in the Republic of Slovenia and the EU.

We ship packages 5x a week from a central warehouse abroad.

Shipping Damage

The buyer should review its contents when picking up the shipment. In case of damage to the shipment, the buyer returns the whole shipment (package, protective packaging, products) to Sostasa d.o.o., who will provide them with a replacement shipment.

14. The Right to Withdraw From the Contract

The purchase is considered to have been made by Remote Contract. The language in which the Contract is concluded is SLOVENIAN.

DESCRIPTION OF THE RIGHT TO WITHDRAW FROM THE CONTRACT:

The buyer may request (in writing, by e-mail, telephone or in person) a remote contract and may receive it by mail at their address, electronically by e-mail or in person at the company headquarters.

The buyer has the right to inform the company within fourteen (14) days from the issuing of the order that they are withdrawing the order without having to give a reason for such a decision. If the buyer has already received the goods, they have the right to notify the company in writing within fourteen (14) days of receipt that they wish to return the goods. If the buyer has already paid for the goods, the company must refund the purchase price immediately or within fourteen (14) days after receiving the notice of withdrawal. The store may refrain from refunding received payments until the product is returned or until the buyer has provided evidence that the product has been sent back unless the company offers the opportunity to get the product back itself.

In case of cancellation of the contract, Sostasa d.o.o. will immediately or no later than fourteen (14) days after receipt of the notice of withdrawal, refund all payments received. The consumer must return the item to the seller undamaged and in unchanged quantity, unless the item is destroyed, defective, lost, or its quantity reduced without the consumer being at fault. The buyer of the items must not freely use them until the contract is terminated. The consumer may inspect and test the items to the extent necessary to determine the actual situation. The buyer is responsible for reducing the value of the goods if the reduction in value is a consequence of the handling that is not strictly necessary to determine the nature, characteristics and operation of the goods. The buyer is not entitled to withdraw from the contract in case of contracts the subject of which is an item made according to the exact instructions of the buyer, which was adapted to their personal needs, which by its nature is not suitable for a refund, that is perishable, or which is past its expiration date. There is no possibility of withdrawal from the purchase of software or audio and video media if the buyer has opened the security seal.

We also exchange the goods if we sent you the wrong product due to our mistake. The full amount of the purchase price (including the shipping cost) will be refunded to you immediately upon receipt of the returned goods.

THE BUYER DOES NOT HAVE THE RIGHT TO WITHDRAW FROM THE CONTRACT AND A REFUND FOR THE PRODUCTS IN CASE:

– products whose price depends on fluctuations in markets that are not affected by the company and which may occur within the term of withdrawal from the contract;
– products that have been manufactured according to the exact instructions of the user;
– products that have been tailored to the user’s personal needs;
– products which are quickly perishable or which have already expired.

15. Material Defect

The buyer may claim their rights from a material defect if they inform the seller (Sostasa d.o.o.) of the defect within two months from the day when the defect was discovered. The buyer must provide a more detailed description of the defect in the notification message and allow us to inspect the matter. The buyer may personally notify the seller of the defect, which must be confirmed by the seller, sent to the store where the item was purchased, or the seller’s agent with whom they have concluded the contract. The seller is not responsible for any material defects in the goods which appear after two (2) years have elapsed since the item was delivered. If the subject of the contract between the seller and the buyer is a second-hand item, the seller is not responsible for the material defects on the goods, which appear after one (1) year has elapsed since the item was delivered. A defect on items is considered to have existed at the time of delivery if it occurs within six months of delivery.

The defect is material:

  • if the item does not have the characteristics necessary for its normal use or for its circulation;
  • if the item does not have the characteristics necessary for the particular use for which the buyer buys it, which the seller has known of or should have known of;
  • if the product has no qualities and distinctions that were explicitly or silently agreed or prescribed,
  • the seller has delivered a product that does not match the sample or model, unless the sample or model was shown only for notification purposes.

The suitability of goods for normal use shall be judged in the light of ordinary goods of the same type and in the light of any seller’s statements concerning the characteristics of the goods made by the seller or manufacturer, in particular by advertising, presenting the product or statements on the goods themselves.

A consumer who correctly informed the seller of a defect has the right to request that the seller:

  • removes the defect on the goods or
  • refunds a portion of the amount paid in proportion to the defect or
  • replaces the faulty goods with new flawless ones or
  • refunds the paid amount.

If the existence of a defect in the goods or irregularity in the service provided is not disputed, the company (Sostasa d.o.o.) will, as soon as possible, but within eight (8) days, satisfy the customer’s request for claiming a material defect. If the existence of a defect in the goods or an irregularity in the service provided is disputable, the company (Sostasa d.o.o.) will respond in writing to the buyer’s request for claiming a material defect within eight (8) days.

The right to a refund in the event of material defects is regulated in more detail by the provisions of the Consumer Protection Act (unofficial consolidated text).

16. Complaint and Dispute Solving

Sostasa d.o.o. will endeavour to resolve any ambiguity, comment or complaint as soon as possible while respecting the law (Consumer Protection Act) and making every effort to reach an agreement.

Comments and complaints are received by the administrative department and are processed by the Legal Service.

The complaint processing procedure is confidential. If no agreement is possible, the court of law in Novo mesto has jurisdiction over disputes.

Within five business days, Sostasa d.o.o. will confirm that it has received the complaint, inform the buyer how long it will be processed, and keep them informed of the progress of the procedure. The provider is aware that the essential characteristic of the consumer dispute, at least in terms of judicial resolution, is its disproportion between the economic value of the claim and the costs arising in the resolution of the dispute itself. This is also the main obstacle for the consumer not to initiate a dispute before a court. That’s why the provider strives to do its best to resolve any dispute by mutual consent.

In accordance with the legal norms, the seller does not recognize any performer of out-of-court settlement of consumer disputes as responsible for resolving a consumer dispute that the consumer could launch in accordance with the Out-of-Court Consumer Dispute Resolution Act. Sostasa d.o.o., which as a provider of goods and services, enables online commerce in Slovenia and the EU, publishes an electronic link to the Consumer Dispute Resolution Platform (SRPS) on its website. The platform is available to consumers online HERE.

That legislation arises from the Act on the extra-judicial settlement of consumer disputes, Regulation (EU) No. 524/2013, of the European Parliament and of the Council on online dispute resolution for consumer disputes and amending Regulation (EC) No. 2016/2004 and Directive 2009/22 / EC.
